1. Agreement to Terms

By accessing or using SwiftTail's services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

SwiftTail is operated by Qureshi Media LLC, a limited liability company organized under the laws of New York State, with its principal place of business in New York City, New York.

2. Description of Service

SwiftTail provides a platform that connects users interested in charter flights with charter flight operators and brokers. We facilitate connections and communications but do not operate aircraft or provide flight services directly.

Our Service includes:

• Flight request submission and management
• Connection with licensed charter operators and brokers
• Communication tools for flight arrangements
• Information about charter flight services

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

4. Acceptable Use

You may not use our Service:

• For any unlawful purpose
• To solicit others to perform unlawful acts
• To violate any international, federal, state, or local regulations, rules, laws, or ordinances
• To infringe upon or violate our intellectual property rights or the rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or malicious code
• To interfere with or circumvent the security features of the Service

5. Third-Party Services

SwiftTail acts as an intermediary platform connecting users with independent charter operators and brokers. We are not responsible for the services provided by these third parties, including but not limited to:

• Flight operations and safety
• Aircraft maintenance and condition
• Pilot qualifications and performance
• Pricing and payment terms
• Flight cancellations or delays

All flight services are subject to the terms and conditions of the actual charter operator or broker you engage with.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Qureshi Media LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Privacy

Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. QURESHI MEDIA LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranty that:

• The Service will meet your requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected

9. Limitation of Liability

IN NO EVENT SHALL QURESHI MEDIA LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

IN NO EVENT WILL QURESHI MEDIA LLC'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO QURESHI MEDIA LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless Qureshi Media LLC and its licensees, licensors, employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your use and access of the Service
• Your violation of any term of these Terms
• Your violation of any third party right
• Any claim that your use caused damage to a third party

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us at contact@flyswifttail.com.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of such courts.

13. Arbitration

Any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in New York, New York before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment on the Award may be entered in any court having jurisdiction.

14. Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED OR REPRESENTATIVE ACTION. You further agree that class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not permitted.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

17. Entire Agreement

These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
